Consequent upon the incessant intimidation and harassment meted on him by the police on the alleged instigation of his estranged wife Mrs Endurance Modupe Makolo, a Lagos based accountant and businessman, Paul Makolo, has filed a fundamental right enforcement suit before the Ikeja division of the Lagos State High Court.

The applicant brought the application for an order for the enforcement of his fundamental right under Sections 35 and 46 of the 1999 constitution of the Federal Republic of Nigeria and Article 6 of the African Charter on human and People’s rights ( Ratification and Enforcement) Act.

Listed as respondents in the suit are the Commissioner of Police , Lagos State Command; the Divisional Police Officer (DPO) Anthony Police Station; Superintendent of Police Istifanus Daniel (IPO) and Mrs Endurance Modupe Makolo as 1st to 4th Respondents respectively.

The applicant in his application before is praying for “A declaration that he is entitled to his personal liberty respectively as guaranteed under Section 35 of the constitution of the Federal Republic of Nigeria 1999 ( as amended)

“A declaration that his arrest and detention on 14th November, 2023 by the 2nd and 3rd Respondents on the complaint of Mrs Modupe Endurance Makolo (4th Respondent) is unlawful and unconstitutional.”
