A Federal High Court in Abuja has dismissed a suit by the Action Alliance (AA) against the presidential candidate of the All Progressives Congress (APC), Bola Tinubu, over alleged forgery.
Justice Obiora Egwuatu, on Tuesday, held that the suit by the AA was statute-barred, having been filed outside the statutory 14 days under the Fourth Alteration of the Nigerian Constitution, 1999.
Justice Egwuatu said the suit had become academic and grossly incompetent, hence, the court lacked the requisite jurisdiction to entertain it, and dismissed same.
The suit by AA, in a suit marked: FHC/ABJ/CS/954/2022, had sued the Independent National Electoral Commission (INEC), APC and Tinubu respectively through its counsel, U.O. Ukairo.

The AA contended that Tinubu’s declaration in his INEC Form CF 001 in 1999 that he attended Government College, Ibadan and the University of Chicago was false.
AA claimed that Tinubu did not possess the certificates he claimed to have acquired from the St. Paul’s Aroloya, Children’s Home School, Ibadan from 1958 to 1964; the Government College, Ibadan from 1961 to 1971; Richard Daley College, Chicago, Illinois, USA from 1969 to 1971; the University of Chicago from 1972 to 1976; and Chicago State University from 1977 to 1979.
The lawyer further contends that the “by virtue of sections 224 and 24 of the 1999 Constitution and the constitution of the 2nd defendant (APC) the office of the President of the Federal Republic of Nigeria is to be occupied by a man of integrity and impeccable character.”
