An FCT High Court yesterday ordered the police to produce a defendant linked to a homicide, Hajia Uwani Hussaini Usman.

 Angela Otaluka gave the order following the absence of Uwani, charged alongside her son, Huzaifa Hussaini Usman, who was alleged to have strangled his father, Alhaji Hussaini Usman, in 2018.

“Bring her on a wheelchair or stretcher to come and take her plea, and after that, we’ll determine whether to grant bail or refuse, depending on the case,” she said.

The judge said having been armed with a letter from the Director of Public Prosecutions in the Federal Ministry of Justice, the onus was on the police to produce Uwani.

In the letter dated May 13, 2022, and signed by the DPP, M.B. Abubakar of the Attorney-General of the Federation, in reply to the police, explained that having reviewed the case, the office “believes that a prima facie case exists against the two defendants in the amended charge and the duo of Musa Ndanusa and Adamu Umar be used as prosecution witnesses.

“In view of the above, I am further directed to inform your office to continue with the prosecution of the case.” 

Earlier, the prosecuting counsel, Godwin Ijioma informed the court that through the directive of the Commissioner of Police in charge of homicide, Uwani was arrested on Saturday and was to be produced to court before she complained of ill-health due to high blood pressure.” 

The defendants were alleged to have carried out the offence on October 28, 2018 at the No B2A Latinwo Street, Adisa Estate, Durumi, Abuja.

 The case was adjourned to June 16 for arraignment.
