Primary: Court to hears suit challenging Tambuwal, February 23

Justice Steven Chukwu Evoh, of the Federal High Court, Abuja, adjourned the case till Monday to allow counsel to the defendant prepare their defence.
Senator Umaru Dahiru and Barr Aliyu Abubakar Sanyinna are the plaintiffs while the APC, Aminu Tambuwal and the Independent National Electoral Commission (INEC) are the defendants.  
One of the grounds upon which the plaintiffs are seeking redress is that  despite the fact that the plaintiffs are bona fide card-carrying members of APC, the party  breached its guidelines as stipulated in the APC guidelines for the nomination of candidates for public office as well as breaching the relevant provisions of the Electoral Act, 2010 (as amended).
The plaintiffs alleged other gross misconducts in the governorship primary election of December 4, 2014, by the officials of Sokoto State government as well as APC officials who allegedly denied all other aspirants except Tambuwal access to the delegates.
It was also alleged that the screening of delegates on the day of the primaries was not done between the stipulated hours of 8am and 12 noon, and that the list of the delegates as issued by the National Secretariat  of APC was not used in the conduct of the said election of December 4, 2014.
Other grounds on which Dahiru is seeking redress is that on the very day of election, members of the Sokoto State and Local Government as well as members of the State Assembly openly canvassed for votes of Tambuwal.
The plaintiffs are asking for a court order directing APC to withdraw the nomination and sponsorship of Tambuwal as the gubernatorial flag bearer of the APC and to hold another governorship primaries in Sokoto State within such reasonable time as may be determined by the court.
The plaintiffs also prayed for an order of court directing the INEC (3rd defendant) to expunge Tambuwal’s name from its register of governorship candidates for the 2015 governorship elections pending fresh holding of gubernatorial primaries in Sokoto State by the APC.
