An ICT expert, Engr Abdallah Suleiman Katsina has sent a fresh petition to the Inspector General of Police alleging false accusation and wrongful prosecution by the Nigerian Police.

Engr Katsina, who had earlier sent a similar petition, has filed a new petition dated May 6th, 2021 and signed by his lawyer, Richard Ebie Esq seeking the arrest and prosecution of Zubairu Borodo over an alleged false accusation, which led to his wrongful prosecution by the Nigerian Police.

In the petition, Katsina alleged “criminal intimidation, criminal conspiracy, suppression of facts, unlawful arrest and detention on an alleged case of forgery, shoddy investigation, malicious prosecution” against the businessman and the police officers at Kano Police Command.

Katsina said Borodo caused the police to arrest him at the Kano airport in March 2019 on the allegation that he signed and reneged on a ‘Letter of Personal Guarantee’ of N30 million in his favour over a telecom investment in 2010, which he was unaware of.

He further stated that to prove his innocence, he spent N40 million and several costs running into millions to get a police forensic result via a laboratory referenced C:3000/KSX/GEN/VOL13/126 dated 12th November 2019, which proved that the signature on the said guarantee was not the same as his, and that bank statements showed no money was paid to him.

In the letter, which he also copied the Minister of Police Affairs, Police Service Commission and the Director General of DSS, he said the police acted on a false information by Borodo to unlawfully detain him and charge him to court, which he is still suffering, forcing him to file a fundamental rights suit before a Federal High Court in Abuja against the police.

I didn’t make false accusation against him—Borodo

In his response through his counsel, B.Y. Gambo, the businessman, Borodo denied claims by Katsina that he levelled false accusation against him, insisting that both Katsina and a director of G-Cell Wireless Nig Ltd, are standing trial before a Magistrate Court in Kano for allegedly convincing him to invest N30 million in the company in 2010.

Borodo, who is the owner of Zin Investment Ltd, said the investment was for the supply of recharge cards and cell phones at a discounted rate as the network covers Kano, Kaduna, Katsina and Jigawa States.

He further explained that he did not meet Katsina again until in an aircraft to Kano in 2019 upon which he reported him to the police and he was arrested and the other director were arraigned after which they paid N1m and pleaded for time to pay the balance.

He said Katsina’s fundamental rights enforcement suits before Federal High Court in Abuja in suit number: FHC/ABJ/CS/1257/19 and FHC/ABJ/CS/1208/19 were transferred to Federal High Court Kano after they raised a notice of preliminary objection as to the venue of the alleged infringement and “at the and the two cases were all dismissed for want of diligent prosecution.”
