Two chieftains of the All Progressives Congress (APC) in Yobe State Ayuba Sabo and Ahmed Abubakar had through their counsel Adeniyi Akintola (SAN) challenged the eligibility of Geidam to contest the April 11 governorship election as candidate of the party.
At the resumed hearing yesterday, counsel to Gaidam, Hassan Fajimite brought a preliminary objection challenging the jurisdiction of the court to hear the suit, adding that the suit is an abuse of court process.
Justice Ahmed Mohammed had ordered service of court processes on the defence including the Independent National Electoral Commission (INEC). But INEC did not file any reply.
The judge consequently adjourned the suit for hearing of the objection.
In the suit, the applicants want the court to determine whether by the provisions of Section 180 (1) and (2) of the 1999 Constitution, are only applicable for a person “elected on the basis of an actual election, or includes one in operation of law, as in the case of Alhaji Ibrahim Geidam.”
