Asabe, along with Linda Ayanwu and one Ibrahim Gaya now at large, were arraigned by the anti-graft agency on a three-count charge of conspiracy, impersonation and obtaining money by false pretence from the Comptroller General of Customs in May this year.

The EFCC represented by Peters Aso, told the court that the accused persons had on May 13, 2009, conspired to obtain money from the Comptroller General of Customs by false pretence, thereby committing an offence contrary to section 8(a) of the Advance Fee Fraud and Other Related Offences Act 2006 and punishable under section 1(3) of the same  Act.

The third charge accused Joy Willams, alias Hajiya Asabe Shehu Musa Yar’adua of falsely representing herself as the wife the late elder brother to President Yar’adua which she is not, thereby committing an offence contrary to section 321 of the Penal Code Act, Cap 532, 1990 and punishable under section 324 of the same Act.

The accused persons pleaded not guilty to the charges.

Counsel representing the accused, Adamu Abdul William, filed an application for bail while the prosecution who opposed the application, told the court that he is entitled to 48 hours to react to the application.

The presiding Judge, Justice Abubakar Talba, adjourned to June 22, 2009 to rule on the bail application and hearing of the matter.
