The subscribers, made up of 350 persons on behalf of other claimants in a suit number HOW/465/2013, are demanding the sum of N3 billion from the multinational telephone communication firm as compensation for their system failure in the country.
Briefing newsmen in Owerri, the leader, a practicing lawyer in the state, Ndioneyema  Nwankwo Esq, disclosed that the decision for the suit is due to serious lapses and inadequacies on the part of the MTN as a GSM provider in the country.
He expressed dismay that MTN may not be the only provider with poor service but the largest network, adding that despite 12 years of global system mobile communication, GSM services in Nigeria which started in August 2001 with Econet and Artel, there still are serious shortcomings.
He regretted that rather than the service improving, it has continued to worsen, adding that  subscribers have been enduring the shortcomings hoping that things will change for the better, but to no avail.
He complained of dropped calls, lack of connection, wrong connections, connections without voicing, lack of delivery of text messages, inability to recharge phones among others.
According to him Nigeria is MTN’s largest market worldwide followed by Iran, South Africa and Ghana, yet Nigeria receives the worst service delivery.
He attributed part of the reasons for the situation to include the inability of the Nigerian Communication Commission (NCC) which is the regulatory body in the country to live up to its statutory responsibility by sanctioning the providers, especially MTN Nigeria.
He said the commission in May 2012 fined all the four providers N1.2 billion for performing below threshold but the situation has instead gotten worst since then.
He said the commission equally charged the providers to pay N2.5 million each day after the final deadline describing the steps as a self-enlightened interest of the NCC.
