The letter dated June 16, 2009 and made available to Newsmen in Abuja accused the Pharmacists Council of Nigeria (PCN) of unlawful closure of the company’s premises on June 15, 2009 under the pretext of regulating pharmaceutical practice in Nigeria.
Ameh said in the letter that when PCN embarked on an unlawful closure of veterinary outfits in the country in 2007 and 2008, his client, Animal Care Consult, unable to resolve matters amicably with the council resorted to seeking a legal redress in the Federal High Court, Abuja in suit No. FHC/ABJ/CS/66/08, pointing out that the action is still pending before the court.
“In the course of the pending proceedings and particularly on the 29th July, 2008, the Court ordered the parties to maintain status quo until the determination of the suit.
“Take notice that the status quo was the uninterrupted and unimpeded position of the plaintiff before the hostilities that led to the dispute of the subject matter of the pending suit”, he added.
He accused the PCN of misleading the IGP to order the closure of the Animal Care Consult and other veterinary clinics and outfits by concealing from him the information of the pending Court order and the subsisting action.
According to the Senior Advocate of Nigeria (SAN), the closure of the company is contemptuous of the pending and subsisting order of the Court which is punishable and urged the IGP to rescind his closure order and direct that the premises be opened forthwith.
