Presidential polls: Court to rule on PDP’s application today 

The Court of Appeal in Abuja will,, today rule on the application by the Peoples Democratic Party (PDP) and its presidential candidate Alhaji Atiku Abubakar to compel the Independent National Electoral Commission (INEC) to produce, for inspection, materials used for the February 23 presidential election.

A three-member panel of judges presided by Justice Abdul Aboki has fixed ruling on the ex parte motion today.

This followed the arguments on the matter by counsel to the PDP, Levi Uzoukwu (SAN) and Chris Uche (SAN).

The lawyers requested the panel to make the order compelling INEC to produce the Voters Register, the Smart Card Reader Machines, Ballot Papers and other sensitive materials for inspection and scanning.

Uche submitted that, based on the time limit for election petitions, the order of the Court of Appeal should include the right to inspect, make copies, scan and conduct forensic of analysis on the election materials.

However, the judges are of the view that the purport of sections 151 and 152 of the Electoral Act is for only inspection of electoral materials.

The judges subsequently retired to chambers to make the ruling.
