The Supreme Court will today deliver judgment in the appeal by a former governor of Osun State, Gboyega Oyetola challenging the election of Ademola Adeleke as his successor.

The apex court fixed the date after the parties adopted their addresses on Monday.

Oyetola had approached the Apex Court after the Court of Appeal on March 25 upheld Adeleke’s election as governor.

The appellate court panel presided by Justice Mohammed Lawal Shuaibu had declared that the All Progressives Congress (APC) candidate and former governor, Gboyega Oyetola failed to prove allegations of over-voting against the Peoples Democratic Party (PDP).

In the unanimous verdict, the appellate court also awarded the sum of N500,000 costs against the APC and its candidate.

The appellate court also dismissed Oyetola’s cross-appeal challenging the authenticity of the African Senior School Certificate Examination (WASSCE) deposed by Adeleke in his Form CF001 in 2018.

The panel said the Oyetola and the APC failed to tender sufficient evidence that the report of the accreditation of voters in the BVAS and the results in form EC8As from polling units being challenged did not tally.

INEC had declared Adeleke the winner with 403,371 votes against Oyetola’s 375,027 votes, while the latter’s figures rose to 314, 921, while Adeleke’s came down to 290, 266 after the tribunal deducted votes in some polling linked with over-voting in Ede South LG.
