A magistrate has dismissed an application by a Nollywood actor and a teacher remanded for the rape of a teenager to leave prison after they complained they were falling ill because the prison was not conducive.
Actor Tunde Amoke and teacher Gbenga Ayeni were remanded on Wednesday for raping a teenager in Osogbo.
Amoke and Ayeni were arraigned at the Magistrate court by Police on Wednesday, October 7 and were remanded till November 4.
Through their counsel, Bola Abimbola Ige, in a motion, on Friday, Amoke and Ayeni begged the court to abridge the adjourment date so that they get bail and leave the correctional centre soon.
Justifying the abridgment application, Ige said the applicants are unkempt at the prison and were falling sick.
The Magistrate, Taofeeq Badmus in his ruling said the defence counsel failed to attach any medical or sick report from any reputable hospital as to the state of health of the applicants or that applicants did not get adequate health attention in the correctional centre if the need be.
The Magistrate dismissed the application, describing it as frivolous, unwarranted and uncalled for.
He said the November 4 adjustment date remains.
