N5bn suit: Out-of-court settlement stalled over non-agreement of terms

The attempt of Edo State chairman of the All Progressives Congress (APC) David Imuse,  to settle out of court in the N5 billion libel suit filed against him by Mike Igini, ex-Akwa Ibom state Resident Electoral Commissioner, was on Thursday stalled due to the non agreement of the settlement terms.

Edo State High Court presided over by Justice Vestee Eboreime had on July 15, 2022 adjourned the case to enable parties settle out of court.

At the resumed hearing, Clement Onwuwuenor ( SAN), counsel to the claimant, told the court that an agreement could not be reached following the collapse of settlement and that he was ready to go on with his client.

Onwuwuenor urged the court to entertain the suit, saying it was scheduled for hearing during the last court sitting.

Counsel to the first defendant,  Austin Osarenkhoe, however, vehemently objected to the position of the claimant’s counsel, citing amongst others that he was yet to file his client’s defense statement to the suit.

Following the claimant’s counsel oral application, the Presiding Judge,  Justice Vestee Eboreimen, recalled Mike Igini to the witness box to continue with his evidence.

Speaking with newsmen shortly after the court proceedings, APC chairman’s counsel, Austin Osarenkhoe said his client couldn’t meet the terms of settlement given by the claimant.

“The terms the claimant brought for the out of Court settlement cannot be accepted. It was just another way of saying I am not settling.

Osarenkhoe, however, noted that both parties are still disposed to settlement.

On his part, Igini’s counsel, Clement Onwuwuenor (SAN), who also corroborated the Imuse’s counsel, said negotiations for settlement out of court broke down because the defendant failed to offer substantial proposal.

He, however, assured that his client was still open to settlement out of court.

The court, therefore adjourned the case to November 15 and 16, 2022 for continuation.

Daily Trust reports that also joined in the suit as as defendants are African Newspapers of Nigeria PLC, publishers of the Tribune titles of Newspapers and the Sun Publishing Ltd, publishers of the Sun titles of Newspapers.
