In an originating summon brought by four Senior Advocates of Nigeria and six others yesterday, Ozoaka wants the court to determine issues contained in Buhari’s affidavit attached to the INEC form and his voter’s card obtained on January 22, 2011 which, according to him, contains “false information about his identity and occupation.”
The lawyer also wants the court to determine whether the name in Buhari’s Secondary School Certificate Examination (SSCE) provided by the Government College Katsina and the Katsina State Ministry of Education is “truly and correctly” that of Buhari, having regard to the name of Buhari in his affidavit submitted to INEC and the name in the said document.
He is asking the court to mandate Buhari to attach his birth certificate and evidence of his educational qualifications in the INEC form under Section 31 (1) (2) and (3)of the Electoral Act, 2010.
Justice Ademola Adeniyi ordered that service of the processes be effected on Buhari and the INEC by substituted means. He adjourned further hearing of the suit to February 9.
