Jos land dispute: Court rules in favour of community

A Plateau State High Court 11, on Wednesday, has ruled on a suit filed against three residents of Jos – Musa Abubakar Pam, Yakubu Ajebu and Mr Bello who are claiming the ownership the land situated along Bauchi-Ring Road, owned by the Filin Sukuwa community.

Recalled that Filin Sukuwa Community Development Association in Jos North Local Government Area of Plateau State has dragged some Jos residents to court over an alleged attempt to seize the land belonging to the community meant for a hospital and school.

The defendants had earlier filed application made by Abubakar Pam seeking an interlocutory injection on the property in dispute. The application was countered by the counsel to the claimant, A. Oloche.

In his ruling, the presiding judge, Justice Nankwat Dawat shashe’et, ruled in favour of the claimant, dismissing an application of the defendants seeking interlocutory order on the property in dispute.

The court stated that, based on the defendants’ argument, the disputed land was not the same as the one they (the defendants) sought for the court to grant an interlocutory injunction on. The court dismissed the defendants’ application due to non-disclosure of the identity of the land for which they were seeking the court’s order.

The court said based on the argument of the defendants, the disputed land was not the one the same with the one they (defendants) want the court to give interlocutory injection, dismissing the application of the defendants for non-disclosure of the identity of the land they were expecting the court to give the order on.
