A Federal High Court in Abuja has restrained the All Progressives Congress against investigating Senator Danjuma Goje over conduct contrary to the party’s constitution.
Justice Ahmed R. Mohammed on April 14 also restrained the APC ward chairman of Kashere Ward in Akko Local Government Area of Gombe State, Tanimu Abdullahi.
The fundamental rights enforcement application was made ex parte by Goje’s counsel, M.A. Ajara Esq.
The court held that the APC and Abdullahi cannot investigate Goje without serving him with any “complaint to enable him prepare for his defence, pending the hearing and determination of the originating motion on notice.”
He further made a restraining order against APC and the ward chairman “their officers, agents and privies from any further breach of the applicant’s right to fair hearing, pending the hearing and the determination of the originating motion on notice.
“An order of this honourable court directing the respondents to stay all actions in this suit, pending the hearing and determination of the originating motion on notice.”
