Court strikes out impersonation, incitement case against Kwara monarch

An Ilorin magistrates’ court, presided over by Magistrate Muhammed Adams, has dismissed a case against ace movie producer, Alhaji Maroof Adebayo Afolayan, who is also a traditional ruler and the Oloba of Isale-Oba, Sanmora in lrepodun LGA of Kwara State.

City & Crime reports that the defendant was dragged to court by the police in March 2022, on the allegation of false personation and inciting public disturbance.

But the court, in its judgement, discharged Oloba of all the offences levelled against him.

In the over 40-page judgement, the court held that the prosecution failed to establish the alleged offences against the defendant and therefore struck it out in its entirety.

Magistrate Adams said the testimony of the six prosecution witnesses claiming that Oloba was purportedly dethroned was invalid.

He said the court lacked jurisdiction to try issues on chieftaincy matters.

The court, through the video evidence presented by two defence witnesses, established that the Eleju of Eju Land, Oba Mathew ldowu Ajiboye and his accomplice, molested Oloba and his family, beating him almost naked. 

Magistrate Adams stated that the prosecution failed to provide sufficient evidence to support their case.
