Court strikes Danzago’s case against Kano APC chair

A Federal High Court in Kano presided by Justice A. M. Liman, has struck out a suit against the Kano State Chapter of the All Progressives Congress (APC) and its chairman, Abdullahi Abbas.

Ahmadu Haruna Zago, who contested for the APC chairmanship position in Kano, had filed a case before the court challenging the election of Abbas as the party’s chairman in the state.

Zago, who claimed to be the winner of the Kano APC congress held in September 2021, said Abbas is occupying the office in contravention of the APC and Nigeria’s constitutions.

Delivering the judgement, Justice Liman said since the plaintiff failed to join the Independent National Electoral Commission (INEC) as a party to the suit, the court lacked jurisdiction to entertain the case.

Reacting to the judgement, the lead counsel to the APC, Barr. M. N. Duru, said: “The court agreed with us that it has no jurisdiction to hear the matter because INEC is not a party to the suit.

Counsel to Zago, Barr. Emmanuel O. said: “We will look at the judgement delivered and discuss with our client to advise whether to appeal or not.”

Similarly, a Federal High Court in Kano yesterday affirmed the Shehu Wada Sagagi-led faction of the Peoples Democratic Party (PDP) as the executives of the party in the state.

A faction, led by Bello Hayatu Gwarzo, loyal to former Foreign Affairs minister, Aminu Wali, had sought an interim injunction to restrain the Sagagi-led executives from parading themselves as rightful leaders of the PDP in Kano.

Delivering the judgement, Justice Liman said the plaintiff had misled the court by demanding an interim injunction restraining the existing leadership.

He said the plaintiff did not have locus standi to file such a demand.

He ruled that since the plaintiff is neither an executive member nor a caretaker or even an aspirant but a member, he has no locus standi to pray for such injunction.
