A Grade 1 Area Court in Gwagwalada on Wednesday refused to grant a man, Muazu Nuhu, custody of his four children who are staying with his former wife, Rahma Abdullahi.
The Judge, Adamu Isah, said the court found it extremely difficult to compel the mother of the children to hand them over, and noted that the welfare and interest of the children were more paramount.
Mr. Isah said the father of the children slept over his right of objection for more than one year, noting that it was trite law where a father of a child knew of the ex-wife’s marriage to another man and yet slept over his right of objection for one year.
“Such a man loses such right and this application for custody is bound to fail and it is hereby refused,” the judge said.
The complainant had approached the court demanding the custody of his four children who live with his former wife, Rahma Abdullahi.
He told the court that since his former wife who he got married to over seven years ago had remarried, the court should order her to hand over the children to him.
He said he wanted the custody of his children because his former wife removed two of his sons from a government secondary school to an almajiri school in Paiko, Niger State.
He also claimed that his former wife sent two of his daughters to hawk in Kwali.
Rahma, however, denied the allegations, saying she sent her daughters to hawk because of lack of care from their father.
