Justice Mohammed Sirajo while ruling on the case, agreed with Shown’s argument that he was not given a hearing before the dissolution of his exco and that he was elected for a four year tenure which cannot be terminated arbitrarily.
The Judged noted that though the PDP constitution empowers its NEC to dissolve the exco of the party in a state, he ruled that that provision of the PDP constitution is undemocratic and violates the Nigerian constitution. He declared that Prof. Showm remains the chairman of the PDP in Plateau State and that the caretaker committee should stop parading itself or carrying out any of the functions given it by the PDP NEC.
