The case was originally brought by Mustapha Maisikeli against Pfizer and the Board of Trustees of the Healthcare/Meningitis Trust Fund whose cases against the company were purportedly settled mutually and dismissed about three years ago.
At the resumed hearing yesterday, Pfizer through its lawyer, Chief Anthony Idigbe, had challenged the amended writ of summons and statement of claim filed on behalf of the plaintiffs.
Daily Trust recalls that Justice Banjoko had earlier ordered alteration of the parties in the suit when both agreed to discontinue the case with them.
Following the order, the plaintiff not only amended the names of the parties to the suit in other to reflect their connection to the case but also made consequential amendment touching on the statement of claim and the pleadings.
However, Pfizer told the court that the plaintiffs cannot change the fact in the middle of the argument.
Pfizer, according to Idigbe, has reconstructed and tried to restructure the facts of the case. According to Pfizer, “this new and latest legal action before the FCT High Court, Abuja is completely groundless and prohibited by unconditional releases signed by these same plaintiffs and delivered to Pfizer as a condition of their resolution of similar past litigation.”
