Chukwumerije’s lawyer Max Ogar told the court that its bailiff was not able to serve PDP’s national leadership notice on the matter due to the festive period. He, therefore, applied for another date to effect service.
Chukwumerije in his suit sought an order of mandatory injunction restraining the Independent National Electoral Commission (INEC) from accepting, relying or making use of any name that may have been presented to it by the PDP for the Abia North Senatorial District.
The senator had polled 21 votes during the party’s December 7 primary for Abia North to come third, while Mao Ohuabunwa polled 103 votes to pick the ticket.
But he contended that the primaries were flawed and prayed the court to stop the submission of any name until the matter is concluded.
Justice Ahmed Mohammed who presided over the case adjourned it to January 16 for hearing of the motion.
