A Court of Appeal sitting in Benin has affirmed the decision of the Edo State Election Petition Tribuna which upheld the election of Sen. Francis Alimikhena, of the All Progressives Congress (APC) as the winner of the Edo North senatorial district election.
The Appeal Court also affirmed the election of Dennis Idahosa of the APC, Jude Ise-Idehen of the Peoples Democratic Party as the winner of Ovia federal constituency and Egor/Ipoba Okha federal constituency respectively.
Also, the appellate court dismissed the appeal filed by Patrick Idiake of the APC, challenging the decision of the lower Court which upheld the election of Joe Edionwele of the PDP as winner of Esan West, Esan Central and Igueben Federal Constituency
Abubakar Momoh, Omosede Igbinedion all of PDP and Johnson Agbonayinma and Patrick Idiake all of the APC had earlier petitioned the Election Petition Tribunal alleging that the election was marred with electoral malpractice and should be declared winners.
The tribunal had dismissed their petitions for lacking in merit and not able to prove the petitions beyond reasonable doubt.
Delivering ruling on the appeal on Friday, the Appeal Court in a unanimous decision dismissed the appeal respectively and upheld the decision of the tribunal.
