The Supreme Court has sacked a member of the House of Representatives for Yola South/Yola North/Girei Federal Constituency of Adamawa State, Abdulra’uf Abdulkadir Modibbo over alleged false information.
A five-member panel of justices presided by Justice John Okoro disqualified Modibbo for supplying false age information and forgery of First School Leaving Certificate to the Independent National Electoral Commission (INEC).
The apex court upheld the decision of the lower courts and held that he participated in partisan politics while serving as a member of the National Youth Service Corps (NYSC) which violates Paragraph 9 of Section 4 of the NYSC Act.
The panel directed the All Progressives Congress (APC) to produce the runner up of the primary of October 7, 2018, Mustapha Usman, as the candidate of the party.
Usman had brought the action at the Federal High Court in Abuja alleging that Modibbo supplied false information to INEC in Form CF001 where he stated that he was born on September 29, 1985, while on February 1, 2012 he made a declaration before an Adamawa High Court that he was born on September 29, 1986.
The Court of Appeal in Abuja also on May 3 upheld the decision of the Federal High Court.
