A Federal High Court sitting in Lagos has adjourned till December 1, 2015 hearing in the enforcement of fundamental right suit filed by the former Minister of Aviation, Princess Stella Oduah.
Oduah, currently a senator representing Anambra North in the upper chamber, approached the court with the claim that the current government was making moves to persecute and humiliate her.
Respondents in the suit were the Economic and Financial Crimes Commission (EFCC), the Independent Corrupt Practices and Other Related Offences Commission (ICPC), the Attorney General of the Federation (AGF) and the Inspector General of Police (IGP).
The former minister sought an order restraining the respondents from probing her over the purchase of two armoured BMW cars by the Nigerian Civil Aviation Authority (NCAA) during her time as minister in 2013.
Oduah had on August 26, 2015 through her lawyer, Mr. R.A Oluyede obtained an interim injunction from the court barring the EFCC from taking any action against her as regards the purchase of the two armoured cars.
But in a preliminary objection, the EFCC challenged the jurisdiction of the Lagos court to entertain the suit.
The agency also said that the Oduah’s claim was baseless and speculative, adding that the former minister failed to place enough material fact before the court to justify her claim that she was about to be invited or arrested.
The commission asked the court to dismiss the former minister’s suit for lacking merit.
At the resumed hearing of the matter on Tuesday a lawyer from Oluyede’s chambers, Mobolaji Akintunde informed the court that his principal was not in court because he had another case before the Ibadan division of the Court of Appeal.
He therefore sought for an adjournment to enable his principal appear in court in person.
Justice Okon Abang then adjourned the matter till December 1, 2015, following the consent of the other parties.
