No petition against Saraki until AGF supplied intelligence to CCB – Witness

The Head of Intelligence Unit of the Code of Conduct Bureau (CCB) Samuel Madojemu on Thursday told the Code of Conduct Tribunal (CCT) that there was no petition filed against Senate President, Bukola Saraki until the Attorney General of the Federation in 2015 briefed the CCB of infractions in his assets declaration forms.

Under cross examination by Saraki’s lead counsel, Chief Kanu Agabi (SAN, Madojemu, testifying as the third prosecution witness, said the CCB and Economic and Financial Crimes Commission (EFCC) decided to collaborate to ensure detailed investigation on infractions discovered in the assets declaration forms following the intelligence supplied by the AGF.

"There was no petition at CCB against the defendant but arising from complaint and intelligence supplied by the Attorney General of the Federation (AGF), the CCB and EFCC decided to collaborate to ensure detailed investigation on infraction discovered in the assets declaration form”, he said.

He said until the time the AGF briefed the CCB chairman about this intelligence in 2015, the CCB had nothing on Saraki.

The witness said the directive given to the investigation team was oral and the terms of reference were equally orally communicated.

In addition, he said on conclusion of the investigation conducted by a team of CCB and EFCC officials, "We briefed the Chairman of EFCC orally after investigation".

The witness added that Saraki was also not invited for interview over claims in his assets declaration forms because he had already made a statement on oath in his assets declaration forms. “It is not compulsory to invite a declarant for interview”, he added.

Madojemu explained that he was not a member of the team that investigated Saraki in 2006 but he was part of the joint team of EFCC and CCB that investigated him in 2015.
 
He explained that the outcome of the 2006 investigation was reviewed by the EFCC and it was discovered that the declaration did not cover the life span of the administration.

The Tribunal thereafter adjourned proceedings to March 21st and 22nd for continuation of cross examination.
