A magistrates’ court at Ogba in Lagos has ordered the remand of a 37-year-old woman, Kafayat Saka, for not being able to produce her husband who is being accused of rape.
Kafayat had stood surety for her husband, Jamiu Saka after he was arrested for having unlawful carnal knowledge of a 14-year-old girl.

However, Kafayat could not produce her husband at the gender section of the Lagos State Command, Ikeja, as agreed.
The prosecutor, Benson Emerhi, told the court that the police decided to charge the woman in place of her husband for not being able to produce him.
Emerhi told the judge, “My Lord, while at the juvenile unit, her husband denied having sex. Consequently, the wife agreed to stand as surety for him.
“He was released to her on the condition that she would bring him anytime the police wanted him for prosecution.
“When it was time to charge the case to court, the police requested the accused to produce her husband. She told the police that her husband packed his property and ran away since they came back and that ever since she had not seen him.
“The police decided to charge the accused in place of her husband.”
The magistrate, Mr M. A. Adegbaye, granted her bail in the sum of N200,000 with one surety in like sum and adjourned the case to April 4, 2022.
